Siemens argued that the ULF vehicle offered in its bid provided a lower floor entry height and greater seating capacity than the Flexity LRV selected by Wiener Linien, albeit at a higher price.

However, the administrative court ruled that Bombardier fulfilled the criteria laid out in the tender and that the evaluation had been carried out properly.

Siemens could now challenge this decision at Austria's High Court, but only if it can prove extraordinary circumstances, which appears unlikely.
