The judge, Mr Geoffrey Vos, dismissed Alstom's application and denied Alstom leave to appeal. He said that Alstom was not likely to win if the case went to a full trial. Nevertheless, Alstom's legal team said they would seek to appeal the decision.

"We have always been confident that we conducted a rigorous tender process and have chosen the best trains for our passengers."
