The Directive covers safety requirements on the Spanish railway network as a whole, and the EC says shortcomings have been identified in the way accidents and incidents are analysed and investigated by the national investigating body as well as in the supervision techniques by the national safety authority.

Spain has been given two months to respond to the concerns raised by the EC. If Spain fails to respond, the EC may decide to issue a reasoned opinion. If Spain still fails to accept or negotiate the opinion, the EC may then bring the case to court.
